Elder Abuse
Sadly, far too many senior citizens in our society experience elder abuse at the hands of nursing homes, assisted living facilities, in-home caregivers, service providers, and even friends and family members. As many as 1 in 10 seniors experience elder abuse, but very few take the steps to report elder abuse and win financial recovery through the legal system, despite the fact that California has some of the strongest legal protections for victims of elder abuse in the country. Why do so few seniors report their abuse? Because they operate under the mistaken assumption that nothing can be done to combat elder abuse, and that others will not believe them. At The Law Offices of Farris Ain, APC, we are committed to fighting for the rights of elder abuse victims in California through pursuing civil suits for financial recovery on behalf of victims, but it is important for family members of elder abuse victims to watch for the signs of elder abuse and to contact us when they suspect elder abuse is occurring.
What is Elder Abuse in California?
Under California’s Elder Abuse and Dependent Adult Civil Protection Act, victims of elder abuse may bring civil actions against perpetrators of elder abuse and their employers in some cases (e.g. nursing homes that employ workers who engage in elder abuse) when the following types of action occurs, injuring an elderly victim:
- Physical Abuse: use of restraints, punching/kicking, burning
- Mental Abuse: yelling, threatening, harassing
- Sexual Abuse: inappropriate touching and other sexual behavior
- Financial Abuse: theft, undue influence, coercion
- Neglect: failure to provide food, medical care, toiletries, cleaning, services
As your attorney, I will use all available means to investigate whether elder abuse has indeed occurred, collect evidence supporting your claim (witnesses, physical evidence, medical evidence), and pursue your claim against all parties to obtain a significant settlement or verdict on your behalf.
